The Process Pt. 1 - Find the Perfect Home In Person Meeting/Evaluate Needs & Wants Working with The Bienstock Group means that you have a whole team behind you looking out for your best interest. Meet with your team to go over the process of purchasing a home and what to expect once you have found a home to purchase. Identify what your perfect home is. Some questions to consider: - Style? - Size? - Price? Figure out Financing/ Prequalify for Home If you’re going to get a loan to purchase your property, you’ll need to speak with a lender to identify how much home you can afford. During this initial pre-qualifying process, your lender will help you understand how much down payment you’ll need, what closing costs will be associated with your purchase, and your estimated monthly mortgage payment. Being armed with a pre-qual letter to present with your purchase offer shows the Seller that you are a serious Buyer. If you decide to purchase your home with all cash and forego a loan, in lieu of a pre-qual letter, you’ll need to present the Seller with bank statements that serve as your proof of funds to show that you are able to close escrow. Pre-Approval requires having qualifying credit. Lenders generally consider: • Character: Indicated by your financial integrity • Capital: Provided by the value of your assets/income Once pre-approved, you can start submitting offers. *Pre-Approvals are subject to property underwriting and appraisal. Borrower must satisfy pre-approval conditions outlined in the commitment letter. Loan amounts subject to property appraisal. - Location? - Fixer or Turn Key? - Parking? - Fireplaces? - Pool? - Backyard? Find the Perfect Home Once we know how much home you can afford, we will start sending you properties that fit your dream home criteria. We’ll walk you through all the homes that pique your interest and work towards the next step of the process. In-Person Meeting/ Evaluate Needs & Wants Prequalify for Home Loan Find the Perfect Home Submit an Offer on a Home Negotiate Terms Offer Accepted
Offer Accepted Now that all the terms have been ironed out and the Seller has accepted your offer, it’s time to open escrow! Negotiate Terms Submit an Offer Once an offer has been submitted, the Seller may choose to counter a few terms that you have written in the purchase agreement. Your agent will work with you to come up with terms that are a win-win scenario for both you and the Seller. The Process Pt. 1 - Submit an Offer Now that we’ve found the perfect home, it’s time to submit an offer. Every offer we submit to the Seller will include the following: Purchase Agreement: This spells out the purchase price you’re offering, how many days you need to close escrow, your loan amount / down payment, and how many days you’ll need for an appraisal, loan, and inspection contingency. We work to present our Buyer’s offer with favorable terms that Sellers will be pleased to receive. Our typical terms for the following contingencies are inspection (10 days), loan (17 days), and appraisal (17 days). *This is subject to change depending on the demand of the home. Pre-Approval / Pre-Qualification Letter: This is an official statement from the lender stating how much your approved loan amount is and at what interest rate you’re receiving for that loan. Proof of Funds: This can be a bank statement or a few statements from various accounts that show liquid assets available for the down payment. Letter of Introduction: This is not always a requirement, but it helps the Seller understand your story. The letter should be a compelling story for why they should accept your offer, why their home has caught your eye, and include a photo of yourself or family for their frame of reference. The Process Pt 2. - Open Escrow Open Escrow Earnest Money Deposit To show good faith to a Seller that you’re a real Buyer, a 3% deposit of the purchase price is to be wired to escrow within 3 business days from the time escrow is opened. Escrow will send out wiring instructions once escrow has been opened and funds must be deposited by the 3rd day. Personal checks are no longer recommended as a form of earnest money deposit as most banks place a 10-day hold on the money before releasing it to the escrow account. The initial deposit is a part of your down payment and not an extra cost. The deposit will be returned to you if you decide not to move forward with the purchase during your contingency period, as long as you have not removed your contingency. It is typical for the Sellers to choose their own escrow company and title company. Once your offer has been accepted, the other agent will let you know who the escrow company is and who the title company is. The escrow company acts as a neutral third party to the transaction and cannot do anything unilaterally. Both Buyer and Seller must agree in writing or via escrow instructions before anything moves forward in a deal, i.e. the release of monies, changing the vesting of title, etc. Title companies provide a preliminary title report within a week of the escrow getting opened and allow for the buyer to review the chain of title, as well any outstanding liens or deficiencies in the title that could hinder the purchase from going through. Begin Loan Process In the application phase, a loan officer will work with you directly to gather all information needed to put your loan in motion. The lender will need to understand your plans for your future to submit a complete loan application. To establish employment history and financial capabilities, a mortgage lender will request documents including, but not limited to: • Pay Stubs for 2-3 months • W-2 Forms for the past year • Most recent 3 months bank statements • All credit account and debit information Once all the necessary documentation is submitted, your lender will send you a loan proposal. After the proposal is accepted, you will move into the underwriting stage. Open Escrow Earnest Money Deposit Begin Loan Process Disclosures Escrow Documents Property Inspections
The Process Pt 2. - Open Escrow As dictated in the purchase agreement, you’ll have “x” amount of days to conduct your physical inspection of the property. Our team has established relationships with vendors who continue to provide clients with honest and unbiased reports. During this period, we recom- mend the following inspections: general, termite, sewer line, roof, HVAC, foundation, plumbing, electrical, chimney (if applicable), mold, and pool (if applicable). Doing an extensive array of inspections upfront not only arms you with the working knowledge of the home, but it also allows for a better case when asking for any credits or repairs. You can expect to receive reports back from inspectors within 48 hours. It is during this time that you and your agent will work towards how you’ll want to proceed with the purchase: a) purchase as-is b) ask for line items to be repaired c) ask for credit at the close of escrow to address the items that were issues identified in the reports. Our agents will always work towards negotiating aggressively on your behalf, but bare in mind that Sellers are not obligated to entertain any requests for repairs or credits. If a Seller does in fact choose to not do anything, it will be your decision to either move forward with purchasing the home as-is or canceling the escrow. Property Inspections Escrow Documents While reviewing seller disclosures, it is imperative that escrow documents are reviewed, signed, and returned to escrow within the first 5 days of receiving them, as escrow needs to know who the purchasing entity is going to be on title. Your escrow package will also contain important information for your lender. Any delay in returning these documents could impact the delivery of your loan approval. The Sellers are required to provide disclosures about the home within your inspection period as well. The most important disclosures are the Transfer Disclosure Statement and the Seller Property Questionnaire. We will walk you through the questionnaires and help you identify any red flags in any of their answers. It is also during this time that escrow will send additional disclosures that come from third-party vendors: Natural Hazards Disclosure, Preliminary Title Report, 9a/City Report. The Process Pt. 2 - Close of Escrow Within 5 days of the closing date, it is advisable to do a Final Walk-Through of the property to ensure that no major damage has ensued during the course of the escrow and that it’s structurally in the same condition as when you first saw the property and put in an offer. Final Walk Through Official loan docs will typically get released to escrow within one week of loan approval. Escrow will coordinate with you on when the signing needs to take place as the documents need to be signed in wet ink and notarized. Escrow will also coordinate the signing of any outstanding escrow documents. Loan Doc Signing / Final Escrow Docs Now that loan docs have been signed, escrow will send you the final amount of funds that will need to be wired into escrow in order to release the file to the title company to close. Keep in mind that it is usually a 1-2 day turnaround to close, once escrow has received your final funds to close in their escrow account. Deposit the Down Payment & Loan Funding The day has finally come to officially record the property in your name and close escrow! On the day of recording, everyone will be on standby as all recordings are done through an online system, in which first come, first serve. The second we hear the good news from escrow, our team will work to meet you at the property and officially hands the keys over to your new home! Recording / Closing Escrow Your lender will order an appraisal of the property after escrow has been opened and you complete your loan application. When your appraisal contingency is due, your lender will let you know if the property has appraised at value or if it has come just below value, in which you will be responsible for bridging the gap between what the property appraised for and the amount you’re purchasing the property. The loan contingency is tied to the appraisal and once we have the value of the home, the lender will then proceed to approve you for the loan and to officially move forward towards closing escrow. This is the last set of the contingencies that will allow you to back out and cancel the deal. Ways a Real Estate Agent Adds Value Your agent serves as a buffer between the buyer and the seller/seller’s agent. Even when a buyer might be willing to pay more for a house or accept less of a credit than the seller might be willing to offer, an agent is both your negotiator and your buffer. Your agent will posture for you and negotiate harder than you would for yourself by understanding what the other side is willing to do and then doing the best possible deal for you. Agents understand property values and will guide you to buy a house for a fair price given the house and the market. Agents know the inspectors and the inspection process. Your agent will find the most comprehensive and honest inspectors in the business who will make sure you know all about the condition of the property. Agents will guide you to lenders and insurance professionals. The market value of a home is what a buyer will pay for it in the current market. There are many factors that contribute to the market value of a home, including: • Location (busier streets sell for less, houses on busy corners sell for less, quieter and tree lined streets sell for more) • Curb appeal • Floor plan • Bedrooms/bathrooms • Interesting architecture and details • Swimming pool and backyard features, including size of the yard • House size and lot size • Cosmetic upgrades (especially for the kitchen, bathrooms, and primary bedroom) • Sunshine • Supply/demand Price is a complex formulation based on all these factors, not just the house size or lot size. Computer generated valuations, like on Zillow or Redfin, have no way of evaluating all the factors that contribute to value, so they will generate an average price based mostly on square footage and general location. Tread carefully when relying on computer generated valuations or valuations based on house size or lot size alone. A valuation needs to be a summary of all the factors that contribute to value.
